Refund Policy

1. Introduction

1.1 This Refund Policy (“Policy”) governs the eligibility, conditions, and procedures for requesting and processing refunds related to subscriptions and services purchased through FluxLMS, a Software-as-a-Service (SaaS) platform operated by Vidhvantri Technologies LLP (“Vidhvantri”, “we”, “us”, or “our”). 1.2 This Policy forms an integral part of the FluxLMS Terms and Conditions and applies to all Users who have made payments for services or subscriptions. 1.3 By initiating a refund request, the User (“Requestor”) agrees to be bound by this Policy and any applicable ancillary policies.

2. Stakeholders

  • Requestors: Any paying User, including individuals, educators, institutions, or enterprises who have made payments for services or subscriptions.
  • Support Team: The designated team responsible for handling refund requests, reachable at admin.fluxlms@vidhvantri.in.
  • Billing Entity: Vidhvantri Technologies LLP, the legal entity responsible for processing payments and refunds.

3. Eligibility

Refunds may be granted under the following conditions:

3.1 Full Refunds

A full refund will be issued if any of the following conditions are met:

  • (a) Platform Inaccessibility: The Platform is inaccessible for more than forty-eight (48) consecutive hours, excluding scheduled maintenance or force majeure events.
  • (b) Double Billing: The User has been charged twice for the same subscription period or service.
  • (c) First-Time Purchase Cancellation: The User cancels their first-time subscription within seven (7) calendar days of purchase and has used the Platform for less than one (1) cumulative hour.

3.2 Pro-Rata Refunds

  • Users on annual plans who downgrade their subscription mid-term may be eligible for a pro-rata refund based on the unused portion of the subscription period.

4. Non-Refundable Items

Refunds will not be issued for the following:

  • Custom enterprise contracts governed by separate Master Service Agreements (MSAs)
  • Add-ons, integrations, or feature bundles purchased separately
  • Overage charges incurred due to exceeding usage limits
  • Promotional or discounted purchases
  • Partial month usage or mid-cycle cancellations
  • Services rendered prior to the refund request

5. Process

5.1 Submission

  • To initiate a refund request, the User must email admin.fluxlms@vidhvantri.in with the following details:
    • Transaction ID or invoice number
    • Reason for the refund request
    • Supporting documentation (e.g., screenshots, error logs)

5.2 Review Timeline

  • Acknowledgement of the request will be sent within twenty-four (24) hours
  • A decision will be communicated within five (5) business days
  • Approved refunds will be processed and credited within ten (10) business days to the original payment method

5.3 Chargebacks

  • Initiating a chargeback through a payment provider without first contacting support constitutes a breach of this Policy
  • Users who initiate chargebacks waive their right to refunds under this Policy
  • Vidhvantri reserves the right to suspend or terminate accounts involved in chargeback disputes

6. Force Majeure

Vidhvantri shall not be liable to issue refunds for service disruptions, delays, or failures caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemics, cyberattacks, or governmental actions.

7. Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India. Exclusive jurisdiction and venue for any dispute arising hereunder shall lie with the competent courts in Chennai, Tamil Nadu.

8. Disclaimer

Refunds are discretionary and subject to verification of eligibility and usage records. Vidhvantri reserves the right to deny refund requests that do not meet the criteria outlined in this Policy or that are deemed fraudulent, abusive, or in violation of the Terms and Conditions.
