1. Introduction
1.1 This Fair Use Policy (“Policy”) governs the responsible and equitable use of FluxLMS, a Software-as-a-Service (SaaS) platform operated by Vidhvantri Technologies LLP (“Vidhvantri”, “we”, “us”, or “our”). 1.2 The purpose of this Policy is to prevent abuse, ensure optimal performance, and maintain fair access to shared resources across all subscription tiers. 1.3 This Policy forms an integral part of the FluxLMS Terms and Conditions and applies to all registered account holders (“Users”).
2. Stakeholders
- 2.1 Users: All individuals and entities with active FluxLMS accounts, including learners, educators, institutions, and enterprise clients.
- 2.2 System Administrators: Authorized personnel responsible for monitoring usage patterns and enforcing this Policy using AWS CloudWatch, custom telemetry dashboards, and automated alerts.
- 2.3 Platform Owner: Vidhvantri Technologies LLP, the legal entity responsible for defining and enforcing fair use thresholds.
3. Acceptable Use
3.1 Users must use FluxLMS in a manner that is lawful, ethical, and consistent with the intended educational purpose of the Platform.
3.2 The following activities are strictly prohibited and constitute violations of this Policy:
- Automated Abuse: Bulk scraping, crawling, or automated access that exceeds published API rate limits or disrupts system performance.
- Content Violations: Uploading or distributing content that is illegal, obscene, defamatory, plagiarized, infringing, or infected with malware or viruses.
- Commercial Misuse: Reselling Platform access, sublicensing accounts, or using FluxLMS to operate a competing service or product.
- Security Breach Attempts: Attempting to bypass authentication mechanisms, exploit vulnerabilities, or access unauthorized data.
3.3 Users are expected to maintain the integrity of the Platform and report suspected abuse to support@fluxlms.com.
4. Resource Limits
4.1 FluxLMS allocates resources based on subscription tier. Usage beyond these thresholds may result in throttling or enforcement actions.

4.2 Throttling:
- Usage exceeding the allocated limits will be automatically throttled to 50% of maximum capacity.
- Throttling is applied dynamically and may affect performance until usage returns to acceptable levels.
4.3 Persistent Abuse:
Repeated violations or sustained overuse may result in account suspension or termination, subject to enforcement procedures outlined in Section 5.
5. Enforcement
5.1 Monitoring:
- Usage is monitored in real-time using AWS CloudWatch and internal telemetry systems.
- Alerts are triggered when usage reaches 80% of allocated thresholds.
5.2 Violation Protocol:
- First offense: Formal warning issued via email
- Second offense: Temporary suspension for seven (7) calendar days
- Third offense: Permanent termination of account and revocation of access
- Users may appeal enforcement actions by submitting a written request to admin.fluxlms@vidhvantri.in within five (5) business days of notification.
5.3 Investigation:
Vidhvantri reserves the right to investigate suspected violations and may request supporting documentation or logs from the User.
6. Force Majeure
6.1 Resource limits and enforcement thresholds may be temporarily adjusted during Force Majeure events, including but not limited to natural disasters, cyberattacks, pandemics, or infrastructure failures.
6.2 Vidhvantri shall not be liable for performance degradation or enforcement delays caused by such events.
7. Jurisdiction
7.1 This Policy shall be governed by and construed in accordance with the laws of India.
7.2 Exclusive jurisdiction and venue for any dispute arising hereunder shall lie with the competent courts in Chennai, Tamil Nadu.
8. Disclaimer
8.1 Vidhvantri reserves the sole and absolute discretion to interpret, enforce, and amend resource limits and acceptable use criteria.
8.2 Any changes to this Policy will be communicated with at least fifteen (15) days’ prior notice via email or Platform announcement. 8.3 Continued use of the Platform after such notice constitutes acceptance of the revised Policy.
